This page states the Terms of Use ("Terms") under which You (as defined below) may use www.SFSCT.com ("SFSCT.com"), an on-line service to post your employment details. SFSCT.com allows Users to create individual profiles, which may include private and personal information (”Profiles”), and to make these Profiles, available to us for assessment.

These Terms include the SFSCT Privacy Statement, each of which is incorporated into these Terms by reference. Please read these Terms carefully. If You do not accept the Terms stated here, do not use SFSCT.com and its services. By using SFSCT.com, You agree to be bound by these Terms, including the SFSCT Privacy Statement.

SFSCT.com ("SFSCT") may revise these Terms at any time by posting an updated version to this Web page. You should visit this page periodically to review the most current Terms because they are binding on You. The terms "You" and "User" as used herein refer to all individuals and/or entities accessing SFSCT.com for any reason. The term “post” as used herein shall mean information that You submit, publish or display on the SFSCT Site (as defined below).

1. Eligibility.
You must be 18 years of age or older, or the age of majority as that is defined in your jurisdiction, whichever is older, to visit or use SFSCT.com in any mode or manner. By visiting SFSCT.com or accepting these Terms, You represent and warrant to SFSCT that You have reached the age of majority in your jurisdiction, and that You have the right, authority and capacity to agree to and abide by these Terms. You also represent and warrant to SFSCT that You will use SFSCT.com in a manner consistent with any and all applicable laws, policies and regulations.

2. Use of content on SFSCT.
SFSCT authorizes You to view and access the matter available on or from SFSCT.com solely for your personal use. The contents of SFSCT.com, and of all other Web sites under SFSCT's control, whether partial or otherwise (SFSCT.com and such other Web sites are sometimes collectively referred to as "SFSCT Sites") such as text, graphics, images, logos, button icons, software and other SFSCT content (collectively, "SFSCT Content"), are protected under both local and foreign copyright, trademark, Brand name and other laws. All SFSCT Content is the property of SFSCT or its content or clients. The compilation (meaning the collection, arrangement and assembly) of all content on the SFSCT Sites is the exclusive property of SFSCT and is protected by local and foreign providers copyright, trademark, and other laws. Unauthorized use of the SFSCT Content may infringe upon these laws, and is strictly prohibited. You must retain all copyright, trademark, service mark and other proprietary notices enclosed in the original SFSCT Content on any authorized copy You make of the SFSCT Content, with proper approvals from the owners of SFSCT.

You will agree not to sell or modify the SFSCT Content or reproduce, display, publicly perform, distribute, or use the SFSCT Content in any way for public or commercial purpose, in connection with products or services that are not connected to SFSCT.com, in any other manner that is likely to cause confusion among users, that disparages or discredits SFSCT or its affiliates, that dilutes the strength of SFSCT's or its affiliate’s property, or that otherwise infringes SFSCT's or its affiliate’s intellectual property rights. You further agree to in no other way misuse data and Content that appears on this Site. The use of the SFSCT Content and data on any other Web site or in any networked computer environment for any purpose is prohibited. Any code created by SFSCT to generate or display any SFSCT Content or the pages contributing to any SFSCT Site is also protected by SFSCT's copyright and you are prohibited from copying or adapting such code.

3. SFSCT Site Restrictions.
Users may not use any SFSCT Site in order to transmit, post, distribute, store or destroy material, including without limitation, SFSCT Content, (a) in violation of any applicable local or foreign law or regulation, (b) in a manner that will infringe the copyright, trademark, trade secret or other intellectual property rights of others or violate the privacy, publicity or other personal rights of others, or (c) that is threatening, abusive, defamatory, obscene, hateful, racially or ethnically offensive any way

Users will ve prosecuted to the full extent of the law, if they violate or attempt to violate the security of any SFSCT Site, including without limitation, the following activities: (a) logging onto a server or account. which such user is not expressly authorized to access and accessing data not intended for such User or logging into a server or account which the User is not authorized to access; (b) attempting to survey, scan or examine the vulnerability of a system or network or to breach security or validation measures without appropriate authorization; (c) attempting to hinder service to any User, host or network, including, without limitation, via means of submitting a virus to any SFSCT Site, overloading, "flooding", "spamming", "mailbombing" or "crashing"; or (d) forging any TCP/IP packet header or any component of the header information in any e-mail or newsgroup posting. Violations of system or network security may result in civil and/or criminal liability. SFSCT will investigate incidents which may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting Users who are involved in such violations.

In order to ensure a safe and valuable experience for all of our customers, SFSCT reserves the right to limit the amount of data (including resume views) that may be retrieved by You in any given time period. These limits may be revised within SFSCT’s exclusive discretion from time to time.

4. Specific Prohibited Uses.
The job posting, resume database (“SFSCT Resume Database”) and other features of SFSCT.com may be used only for lawful purposes by individuals seeking employment and career information. SFSCT Networking and Profile outlines may be used only for lawful purposes by individuals authorized to do so.

SFSCT specifically prohibits any unauthorised use of SFSCT.com, and all Users agree not to do any of the following: (a) post any jobs on any SFSCT Site for any competitor of SFSCT or post jobs or other content that contains links to any site competitive with SFSCT; (b) post jobs or content on any SFSCT Site that contain hyperlinks, "hidden" keywords or keywords that are irrelevant to the job or are otherwise misleading; (c) post jobs for modeling or talent or talent scouting positions on any SFSCT Site; (d) use any SFSCT Resume Database for any purpose other than as an employer seeking employees (f) post or submit to any SFSCT Site any incomplete, false or inaccurate biographical information or information which is not your own; (g) post on any SFSCT Site any, pyramid scheme, "club membership", distributorship or sales representative arrangement or other business opportunities which require payments either, up front or periodic, pays commissions only or requires recruitment of other members, sub-distributors or sub-agents; (h) send unsolicited mail or e-mail, make unsolicited phone calls or send unsolicited faxes regarding promotions and/or advertising of products or services to a User of any SFSCT Site; (i) delete or revise any material posted by any other person or entity; (j) take any action that inflicts an unreasonable or disproportionately sizeable load on any SFSCT Site's infrastructure; (k) notwithstanding anything to the contrary contained herein, use or attempt to use any engine, software, tool, agent or other device or mechanism (including browsers, spiders, robots, avatars or intelligent agents, without limitation) to navigate or search any SFSCT Site other than the search engine and search agents available from SFSCT on such SFSCT Site and other than generally available third party web browsers (e.g., Internet Explorer, Firefox, Safari); (l) decipher, decompile, disassemble or reverse engineer any of the software comprising or in any way making up a part of any SFSCT Site; (m) aggregate, copy or duplicate in any method any of the SFSCT Content or information available from any SFSCT Site, without express written consent from SFSCT; or (n) frame or link to any SFSCT Content or information available from any SFSCT Site.

If you of the belief that something on the Site violates these Terms please contact our designated agent by email or mail.

If notified by a User of materials which allegedly do not conform to these Terms, SFSCT may in its sole discretion investigate the allegation and determine whether to take any other actions whether to remove or request the removal of the User and the User Content. SFSCT has no liability or responsibility to Users for performance or nonperformance of such activities.

5. Registration Information.
When You register/use with any SFSCT Site, You will be asked to provide SFSCT with certain information including, without limitation, a valid email address (your "Information"). Information you submit will be used in accordance with SFSCT's Privacy Statement.

6. User Content and Submissions.
You are solely responsible for your Account information, employer account information or job postings, Profile, content (including, without limitation works in any form, media, or technology whether now known or later developed), messages, audio, video, photos, text, images, compilations or other information ("User Content") that You post on any SFSCT Site. You agree that in submitting User Content or otherwise using any SFSCT Site that you will not impersonate any person, or submit any materials to SFSCT that are false, inaccurate, misleading, unlawful, or are otherwise in violation of your obligations under these Terms.

By posting User Content to SFSCT Site, You automatically grant to SFSCT and its affiliates an irrevocable, royalty-free, perpetual, fully paid non-exclusive right (including moral rights) and worldwide license to use, copy, reproduce, modify, adapt, publish, translate, communicate to the public, perform, display, and distribute such User Content (in whole or in part) and to prepare derivative works of, or incorporate into other works (in any form, media or technology now known or later developed, for the full term of any rights that may exist in such content) such User Content, and to grant and authorize sublicenses thereof (through multiple tiers).

SFSCT may act as a passive conduit for the online distribution and publication of User Content and has no obligation to screen User Content, communications or information in advance and is not responsible for screening or monitoring User Content posted by Users in such cases. However, SFSCT may review and remove any User Content that, in its sole judgment, violates these Terms, violates applicable laws, rules or regulations, is abusive, disruptive, offensive or illegal, or violates the rights of, or harms or threatens the safety of, Users of any SFSCT Site. SFSCT reserves the right to disqualify applicants and prevent their further access to the SFSCT Sites and/or use of SFSCT services for reasons of violating the Terms or applicable laws, rules or regulations. SFSCT may take any action with respect to User Content that it deems necessary or appropriate in its sole discretion if it believes that such User Content could create liability for SFSCT, damage SFSCT’s brand or public image, or cause SFSCT to lose (in whole or in part) the services of its providers and suppliers.

The following is a partial (not exhaustive) list of User Content that is prohibited on the SFSCT Sites. The list below is for illustration only and is not a complete list of all prohibited User Content.

It is also a violation of the Terms, to include in any User Content submitted to SFSCT, Networking information that may be interpreted as direct solicitation, advertisement or recruitment for an available job position.

Any Profile You submit must describe You, an individual person. Examples of unacceptable and prohibited Profiles include, but are not limited to, Profiles that purport to characterize an animal, place, inanimate object, fictional character, or real individual that is not You. You may not include in your Profile any details that are not yours at the time of applying. You may not apply for a third party or anyone that is not you. You may not provide details pertaining to third party applicants that are not relevant to You.

SFSCT will independently verify the information provided by candidates or the identity of candidates as the site owners deem appropriate using the information provided by You on the application form..

If notified by a User of User Content or other materials which allegedly do not conform to these Terms, SFSCT may in its sole discretion investigate the allegation and determine whether to take any other actions whether to remove or request the removal of the User Content.

We appreciate hearing from our Users and welcome your comments regarding our services and the SFSCT Sites. Please be advised, however, that our policy does not include the acceptance or consideration of creative ideas, suggestions, inventions or materials unless strictly requested by us. We do value your feedback on our services, please be specific in your comments regarding our. If, despite our request, You send us creative suggestions, ideas, drawings, concepts, inventions, or other information (collectively the "Submission"), the Submission shall be the property of SFSCT. None of the Submission shall be subject to any obligation of confidentiality on our part and we shall not be liable for any use or disclosure of any Submission. SFSCT shall own exclusively all now known or later discovered rights to the Submission and shall be entitled to unrestricted use of the Submission for any purpose whatsoever, commercial or otherwise, without compensation to You or any other person.

The list of products available on SFSCT, but is not limited to what is available at the time of your application. These product offerings are subject to change at any time with or without notification.

If You believe that your copyrighted work or trademark has been uploaded, posted or copied to any SFSCT Site and is accessible on such SFSCT Site in a way that constitutes copyright or trademark infringement, please Notifify us through our email section.

Policy Regarding Users Who Repeatedly Infringe The Copyright Or Other Intellectual Property Rights Of Others
SFSCT, Inc., and all of its affiliates respect the intellectual property of others, and we ask our Users to do the same. The unauthorized posting, reproduction, copying, distribution, modification, public display or public performance of copyrighted works constitutes infringement of the copyright owners rights. As a condition to your use of SFSCT.com, You agree not to use SFSCT.com or any other SFSCT Site to infringe the intellectual property rights of others in any way. We will disqualify the applications of any SFSCT.com Users, and block access to SFSCT.com and/or the other SFSCT Sites of any Users who are repeat infringers of the copyrights, or other intellectual property rights, of others. We reserve the right to take these actions at any time, in our sole discretion, with or without notice, and without any liability to the User whose application is disqualified.

7. SFSCT's Liability.
SFSCT.com acts as a venue candidates to post resumes and Profiles. SFSCT is involved in the actual transaction during the hiring process. SFSCT makes no representations about any jobs available other that the specified. SFSCT may take any action with respect to User Content that it deems necessary or appropriate in its sole discretion if it believes that such User Content could create liability for SFSCT, damage SFSCT’s brand or public image, or cause SFSCT to lose (in whole or in part) the services of its providers and suppliers. While SFSCT reserves the right in its sole discretion to disqualify resumes or other material from SFSCT.com from time to time, SFSCT does not assume any obligation to do so and disclaims any liability for failing to take any such action.
We expect that You will use caution and common sense when using SFSCT.com and/or the other SFSCT Sites.

Because we do not and cannot be involved in User-to-User dealings or control the behavior of participants on any SFSCT Site, in the event that You have a dispute, personal or otherwise, with one or more Users that you know of or presume to know, You release SFSCT (and our agents and employees) from claims, demands and damages (actual and consequential and direct and indirect) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.

The SFSCT Sites may contain inaccuracies or typographical errors which we will modify at regular intervals. Changes are periodically made to SFSCT Sites and may be made at any time. You acknowledge and agree that You are solely responsible for the form, content and accuracy of any resume or material contained therein placed by You on the SFSCT Sites.

SFSCT cannot guarantee and does not promise any specific results from use of SFSCT.com or any SFSCT Site. No advice or information, whether oral or written, obtained by a User from SFSCT or through or from SFSCT.com or any other SFSCT Site shall create any warranty not expressly stated herein.

8. Disclaimer of Warranty.
SFSCT DOES NOT WARRANT THAT ANY SFSCT SITE WILL OPERATE ERROR-FREE OR THAT ANY SFSCT SITE AND ITS SERVERS ARE FREE OF COMPUTER VIRUSES OR OTHER HARMFUL MECHANISMS. IF YOUR USE OF ANY SFSCT SITE OR THE SFSCT CONTENT RESULTS IN THE NEED FOR SERVICING OR REPLACING EQUIPMENT OR DATA, SFSCT IS NOT RESPONSIBLE FOR THOSE COSTS. THE SFSCT SITES AND SFSCT CONTENT ARE PROVIDED ON AN "AS IS" BASIS WITHOUT ANY WARRANTIES OF ANY KIND. SFSCT, TO THE FULLEST EXTENT PERMITTED BY LAW, DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE WARRANTY OF MERCHANTABILITY, FITNESS FOR PARTICULAR PURPOSE AND NON-INFRINGEMENT. SFSCT MAKES NO WARRANTIES ABOUT THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF THE SFSCT CONTENT, SERVICES, SOFTWARE, TEXT, GRAPHICS, AND LINKS.

9. Disclaimer of Consequential Damages.
IN NO EVENT SHALL SFSCT, ITS SUPPLIERS, OR ANY THIRD PARTIES MENTIONED ON ANY SFSCT SITE BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, INCIDENTAL AND CONSEQUENTIAL DAMAGES, LOST PROFITS, OR DAMAGES RESULTING FROM LOST DATA OR BUSINESS INTERRUPTION) RESULTING FROM THE USE OR INABILITY TO USE ANY SFSCT SITE AND THE SFSCT CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT SFSCT IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10. Links to Other Sites.
SFSCT.com and SFSCT Sites may contain links to third party Web sites. These links are provided solely and presumably as a convenience to You and not as an endorsement by SFSCT of the contents on such third-party Web sites. SFSCT is not responsible for the content of linked third-party sites and does not make any representations regarding the content or accuracy of materials on such third party Web sites. If You decide to access linked third-party Web sites, You do so at your own risk.

11. No Resale or Unauthorized Commercial Use.
You agree not to assign your rights or obligations under these Terms. You also agree not to make any unauthorized commercial use of any SFSCT Site.

12. Indemnity.
You agree to defend, indemnify, and hold harmless SFSCT, its affiliates, and their respective officers, directors, employees and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from (i) any User Content or other material You provide to any SFSCT Site, (ii) your use of any SFSCT Content, or (iii) your breach of the terms of these Terms. SFSCT shall provide notice to You promptly of any such claim, suit, or proceeding.

 

13. General.
SFSCT makes no claims that the SFSCT Content may be lawfully viewed or accessed outside of the country of origin. (Access to the SFSCT Content may not be legal by certain persons or in certain countries). If You access a SFSCT.com Sites from outside of the United States, You do so at your own risk and are responsible for compliance with the laws of your jurisdiction. No changes to these Terms shall be made except by a revised posting on this page.

14. Term and Termination
These Terms will remain in full force and effect while You are a User of SFSCT.com at any level. SFSCT reserves the right, at its sole discretion, to pursue all of its legal remedies and actions, including but not limited to disqualification of Your User Content from SFSCT.com and immediate termination of your application upon any breach by You of these Terms or if SFSCT is unable to verify or authenticate any information You submit to SFSCT.com. Even after You are disqualified, applicable provisions of these Terms will remain in effect.

These Terms constitute a binding agreement between You and SFSCT, and is accepted by You upon your use of the SFSCT Site.

15. Usage of Data
We strive to provide a safe, secure user experience. This Privacy Statement sets forth the online data collection and usage policies and practices that apply to the SFSCT and SFSCT Networking Web Sites (sometimes referred to herein as the "SFSCT Sites") and does not apply to information we collect in any other fashion.

Your data will be stored and processed in whole or by the owners of the website. The information we gather on the SFSCT Sites may be shared within the SFSCT-affiliated companies on a worldwide basis in order to deliver the products and services we offer to "Affiliated companies" means entities that control, are controlled by or are under common control with SFSCT, Inc.

The SFSCT Sites may contain links to other Web sites over which we may have no control. We are not responsible for the privacy policies or practices of other Web sites to which you choose to link from our Sites. We encourage you to review the privacy policies of those other Web sites so you can understand how they collect, use and share your information.

16.Collection and Use of Information by SFSCT
In some areas of SFSCT, we request or may request that you provide personal information, including your name, address, e-mail address, telephone number, contact information and any other informationn from which your identity is discernible. In other areas, we collect or may collect demographic information that is not unique to you such as your ZIP code, age, preferences, gender, interests and favorites. Sometimes we collect or may collect a combination of the two types of information.

We also gather or may gather certain information about your use of SFSCT. Moreover, there is information about your computer hardware and software that is or may be collected by us. This information can include without limitation your IP address, browser type, domain names, access times and referring Web site addresses, but is not linked to your personal information.

We may sometimes afford you the opportunity to provide descriptive, cultural, behavioral, preferential and/or life style information about yourself, but it is solely up to you whether you furnish such information. If you do provide such information, you are thereby consenting to the use of that information in accordance with the policies and practices described in this Privacy Statement.

17.Our Use of Your Information
We use the information we gather on SFSCT or SFSCT Networking, whether personal, demographic, collective or technical, for the purpose of operating and improving the SFSCT Sites, fostering a positive user experience.

we may also use the information we gather to inform you of other products or services available from us or our affiliated companies.

We may use your contact information in order to send you e-mail or other communications regarding updates at the SFSCT Sites, to contact you about your opinion of current products and services or potential new products and services that may be offered. We may also provide additional information on new SFSCT opportunities. The nature and frequency of these messages will vary depending upon the information we have about you.

You may receive free informational newsletters from us relating to topics that may be of special interest to you.
When you submit feedback, the information you submit in these areas becomes our property, and we can use such feedback (such as success stories) to contact you for further information.

18.Choices Regarding the Disclosure of Personal Information to Others
We do not disclose your personal information to third parties, or your combined personal and demographic information or information about your use of SFSCT or SFSCT Networking (such as the areas you visit or the services you access), except as set forth below.

1.          We disclose information to third parties if you consent to such disclosure. We use data we have about you (such as the interests and preferences you have expressed) to determine whether you might be interested in the opportunities, products or services of a particular third-party.

 2.         We disclose information to companies and individuals we employ to perform functions on our behalf. Examples include hosting our Web servers, analyzing data, providing marketing assistance, processing applications, and providing customer service if and when we use these services. These companies and individuals, if and when we use them, will have access to your personal information as necessary to perform their functions, but they may not share that information with any other third party.

3.          We disclose information if legally required to do so, if requested to do so by a governmental entity or if we believe in good faith that such action is necessary to: (a) conform to legal requirements or comply with legal process; (b) protect our rights or property or our affiliated companies; (c) prevent a crime or protect national security; or (d) protect the personal safety of users or the public.

 4.         We may, if and when, it is required, disclose and transfer information to a third party who acquires all or a substantial portion of our business, whether such acquisition is by way of merger, consolidation or purchase of all or a substantial portion of our assets. In addition, in the event we become the subject of a bankruptcy proceeding, whether voluntary or involuntary, we or our trustee in bankruptcy may sell, license or otherwise dispose of such information in a transaction approved by the bankruptcy court. You will be notified of sale of all or a substantial portion of our business to a third party via email or through a prominent notice posted on the SFSCT Sites.

We may also share aggregated anonymous information about visitors to SFSCT (aggregate on an anonymous basis data regarding job qualifications, schooling, age, experience level or other information relevant to the job search or competition among Seekers for any such job.) for our own purposes. Such data may be made available to employers or fellow job seekers.

If you apply for a position on SFSCT you may be asked to provide information on your gender, race or other protected status where permitted by applicable law. We may be required by law to gather this information from job applicants for reporting and record-keeping requirements. You should understand that if provided, this information will be used by us only in accordance with applicable law and will not be used in making any negative employment decisions. All information provided will be kept separate from your expression of interest in any job opportunity. Providing this information, in cases where requested, is strictly voluntary and you will not be subject to any adverse action or treatment if you choose not to provide this information.

We attempt to limit access to our resume database (or copies thereof) to our personal  human resource professionals, for assessment purposes. You may remove your resume on SFSCT or request deletion of your profile on SFSCT by emailing us at anytime, in which event we will remove all our copies of your resume from SFSCT. The cancellation will be valid only on receipt of your email and acknowledgement from us.  

We may use "cookies" to help personalize and maximize your online experience and time online. A cookie is a text file that is placed on your hard drive by a Web page server. Cookies are not used to run programs or deliver viruses to your computer. Cookies, if and when used,  are uniquely assigned to your computer, and can only be read by a Web server in the domain that issued the cookie to you. Using cookies may deliver faster and more accurate results and a more personalized site experience.

You may have the ability to accept or decline cookies. Most Web browsers automatically accept cookies, but you can usually modify your browser setting to decline all cookies if you prefer. Alternatively, you may be able to modify your browser setting to notify you each time a cookie is tendered and permit you to accept or decline cookies on an individual basis.

19. Use of Web Beacons
SFSCT may contain electronic images known as Web beacons (sometimes called single-pixel gifs) that allow us to count users who have visited those pages. Web beacons are not used to access your personally identifiable information; they are a technique that may be used by us to compile aggregated statistics about our Web site usage.
You may not decline web beacons, however, they can be rendered ineffective by declining all cookies or modifying your browser setting to notify you each time a cookie is tendered and permit you to accept or decline cookies on an individual basis.

20. Security of the Personal Information
We have implemented commercially reasonable technical and organizational measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, modification or disclosure. However, we cannot guarantee that unauthorized third parties will never be able to defeat those measures or use your personal information for improper purposes.

21. Children
The SFSCT Sites are not intended for children under 13 years of age. We do not knowingly collect personal information from children under 13 protecting children’s privacy. We do not and will not process any information from children under 13 years of age. If any data indicates to us that the applicant is 13 or below, we will not process or accept the application.

22. Changes to Privacy Statement
If we decide to materially change our Privacy Statement for SFSCT and we will post those changes through a prominent notice on the web site so that you will always know what information we gather, how we might use that information, and to whom we will disclose it.
